User Agreement & Terms of Service

PLEASE READ THIS AGREEMENT CAREFULLY. IT CONTAINS LEGALLY BINDING TERMS REGARDING FEES, LIABILITY LIMITATIONS, AND YOUR RIGHTS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICES. 

This User Agreement & Terms of Service (“Agreement”) is a legally binding contract between KidsKart Ltd (“KidsKart,” “We,” “Us,” or “Our”) and You (“User,” “You,” or “Your”). KidsKart app is a brand operated by SD Ventures a limited liability company registered in Panama. KidsKart app is powered by TDMN and Managed by CartR. 

1. SERVICES COVERED BY THIS AGREEMENT 

Our Services include: 

  • Rental of Kids Carts, Strollers & Cars 
  • Related equipment, maintenance, and app-based services 
  • Use of Our website (wwwkids-kart.com) and mobile application (the “App”) 

By using these Services, You agree to comply with this Agreement and any Additional Terms displayed in the App. 

2. RENTAL & USAGE TERMS 

2.1 You Are the Sole User 

  • You confirm that You are the only person using the rented Product. 
  • Sharing or allowing another person to use the Product is strictly prohibited. 

2.2 Age Requirements 

  • You must be at least 18 years old to rent a KidsKart. 
  • If aged 16-17, You must have parental consent and assume full responsibility. 

2.3 Fitness & Competency 

  • You confirm that You are physically able to use the Product safely. 
  • You assume all risks related to operation in various weather or road conditions

2.4 Ownership of Products 

  • The rented Products remain the exclusive property of KidsKart
  • You must not dismantle, modify, or damage the Product in any way. 

2.5 Approved Usage Areas 

  • You may only use KidsKart Products in approved areas listed in the App. 
  • Restricted areas are strictly prohibited, and violation may result in penalties. 
  • If You leave the Product outside the designated area, a retrieval fee of $160 USD may apply. 

2.6 Compliance with Laws 

  • You must follow all local laws and traffic rules while using the Product. 
  • You are solely responsible for any fines, fees, or penalties incurred. 

3. PAYMENT & FEES 

3.1 Pricing & Charges 

  • Fees are displayed in the App and charged per rental session
  • Charges include applicable taxes and processing fees

3.2 Payment Method 

  • You must provide a valid credit/debit card before renting. 
  • KidsKart is authorized to charge Your card for all applicable fees. 

3.3 Penalties & Additional Fees 

  • Late Return Fee: Rentals exceeding 24 hours incur a $285 maximum charge
  • Non-Return Fee: If the Product is not returned within 48 hours, it will be considered lost/stolen. You may be charged up to $2,810 and a police report may be filed. 
  • Improper Parking Fee: If You abandon a Product in an inaccessible or private area, a retrieval fee of up to $170 USD may apply. 

4. SUBSCRIPTIONS & AUTO-RENEWALS 

  • Monthly subscription users agree to automatic renewals unless canceled. 
  • Cancellation: You may cancel anytime via the App, but no partial refunds apply. 
  • Price Changes: KidsKart reserves the right to update pricing with prior notice

5. SAFETY & LIABILITY 

5.1 Safety Checks 

  • Before using, You must inspect the Product for damages. 
  • If You detect any issues, do not use the Product and report it immediately. 

5.2 Accident & Damage Reporting 

  • If You are involved in an accident, injury, or theft, You must report it immediately
  • If the Product is damaged, You may be liable for repair costs up to $2,800 USD

5.3 Risk Warning & Waiver 

  • You assume all risks associated with using the Product. 
  • KidsKart is not liable for injuries, damages, or losses incurred while using the Product. 

6. TERMINATION & SUSPENSION 

  • We may suspend or terminate Your account if You violate this Agreement. 
  • Upon termination, You must return all rented Products immediately

7. PRIVACY & DATA PROTECTION 

  • We collect personal data in accordance with Our Privacy Policy
  • By using Our Services, You consent to the collection and use of Your data. 

8. DISPUTE RESOLUTION 

  • Disputes must be resolved within 90 days through negotiation. 
  • If unresolved, the dispute may be taken to the courts of Panama or Your local jurisdiction

9. MISCELLANEOUS TERMS 

  • Force Majeure: We are not responsible for service disruptions caused by natural disasters, strikes, or unforeseen events
  • Changes to Terms: We may update this Agreement, and continued use of the Services constitutes acceptance of the revised terms.

Acceptance of Agreement By using KidsKart services, you acknowledge that you have read, understood, and agree to this Agreement.
